Precedence: To the extent that anything associated with the Site is in conflict with these Terms, these Terms shall prevail.
Headings: Headings are included for convenience only and will not limit or otherwise affect these Terms.
Waiver: Any failure to exercise a right under these Terms will not create a continuing waiver or expectation of non-enforcement.

Online Store Terms & Prohibited Uses

7. Data Transmission (POPIA Compliance)
You understand that your content (excluding credit card information) may be transferred unencrypted over various networks to meet technical requirements. Credit card information is always encrypted during transfer. We implement reasonable technical measures to protect your data in accordance with the Protection of Personal Information Act (POPIA).
8. Prohibited Conduct
In addition to other prohibitions, you are strictly prohibited from using the Site or its content:

Obligation and Conduct
1. Legal Capacity and Eligibility
You agree that you are of legal age and have the legal capacity to agree to these Terms. If you are under the age of 18, you acknowledge and confirm that you may not purchase any products from ShaRique Skin and may only access the Site under the supervision of a legal guardian.
2. Registration and Data Accuracy
In accordance with our data protection standards, you agree:
To provide accurate, current, and complete information as prompted by any registration form on the Site (“Registration Data”);
To maintain and promptly update your Registration Data to ensure it remains accurate and complete;
To maintain the security and confidentiality of your password and identification.
3. Security and Unauthorized Access
You are responsible for all activities that occur under your account. You must notify ShaRique Skin immediately of any unauthorized use of your account or any other breach of security. While you acknowledge the inherent risks of online data transmission, ShaRique Skin implements reasonable technical measures to protect your Registration Data in line with South African law.
4. User-Generated Content
You are entirely responsible for all content—including text, reviews, videos, and photographs—that you upload, post, or otherwise transmit through the Site (“User Content”).
You agree not to upload, post, or transmit User Content that:
Is inaccurate, harmful, obscene, defamatory, racist, violent, offensive, harassing, or otherwise objectionable to ShaRique Skin or other users;
Includes the unauthorized disclosure of personal information of any third party;
Violates or infringes upon anyone’s intellectual property rights;
Contains software viruses or any code designed to interrupt, destroy, or limit the functionality of any computer software, hardware, or telecommunications equipment.
5. Right to Moderate
ShaRique Skin reserves the right to edit, move, or remove any User Content that violates these Terms, contains unauthorized third-party commercial advertisements, or for any other reason deemed necessary to maintain the integrity of the Site.
Products and Pricing
1. Product Display and Accuracy
The Site allows you to view and purchase products curated by ShaRique Skin. We have made every effort to display the colors and images of our products as accurately as possible. However, we cannot guarantee that your computer monitor’s or mobile device’s display of any color will be an exact match to the physical product.
2. Sales and Quantity Limitations
We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We further reserve the right to limit the quantities of any products or services that we offer. Any offer for any product or service made on this Site is void where prohibited by law.
3. Descriptions and Pricing
Changes without Notice: All descriptions of products and product pricing are subject to change at any time without prior notice, at our sole discretion.
Price Adjustments: Prices for our products are subject to change; however, once an order has been confirmed and paid for, the price for that specific transaction is locked.
Discontinuation: We reserve the right to discontinue any product at any time. We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of a product.
4. Quality and Expectations
While we provide high-quality formulations backed by research, ShaRique Skin does not warrant that the quality of any products, services, or information purchased will meet your subjective expectations, or that every error in the service will be corrected. To the greatest extent permissible by South African law, ShaRique Skin grants no warranties, express or implied, as to merchantability, fitness for a specific purpose, or the results of the use of its products.
5. Safety and Patch Testing
Clinical Safety Protocol: We strongly recommend that you conduct a patch test before applying any ShaRique Skin products to a larger area.
If a patch test causes any adverse skin reaction (such as redness, itching, or burning), discontinue use immediately and consult a medical professional.
ShaRique Skin provides detailed ingredient lists for your review to assist in identifying potential sensitivities before purchase.
Orders, Payment, and Delivery
1. Payment Methods and Processing
At present, payments are accepted via our secure online payment gateways: Yoco and PayFast.
Card Payments: Products will be released only once payment has been cleared and confirmed by the gateway.
EFT/Direct Deposit: For orders paid via Electronic Funds Transfer (EFT), payment must be made within 2 calendar days of placing the order. If a valid proof of payment is not received within this timeframe, ShaRique Skin reserves the right to cancel the order.
(Shipping & Delivery Clause)- We offer a flat-rate shipping fee of R130 for deliveries within South Africa. However, please note that certain outlying or high-risk areas may incur additional courier surcharges. In such instances, we will contact you via email with the revised shipping cost. You will then have the option to pay the additional fee to proceed with the order or request a full refund
2. Delivery Timeline
Once an order is accepted and payment is cleared, we will provide you with a dispatch notice.
Delivery Period: We aim to deliver goods within 10 calendar days of receipt of payment.
Delays: Should we be unable to deliver within this period, we will notify you. You will then have 5 calendar days from the date of notification to elect whether to cancel the order for a full reimbursement or agree to a new delivery date.
3. Fulfillment and Risk
Completion of Delivery: ShaRique Skin’s obligation to deliver is fulfilled once the goods reach the physical address nominated by you.
Transfer of Risk: In accordance with the CPA, the risk of loss or damage to the goods remains with ShaRique Skin until the goods are delivered to you. Once the delivery is complete at the nominated address, the risk passes to you, and we are not responsible for subsequent loss or unauthorized use.
4. Right to Refuse or Limit Orders
We reserve the right to refuse any order for legitimate business reasons. At our sole discretion, we may limit or cancel quantities purchased per person, per household, or per order.
These restrictions may apply to orders placed under the same account, credit card, or shipping address.
We reserve the right to prohibit orders that, in our judgment, appear to be placed by unauthorized dealers, resellers, or distributors.
5. Accuracy of Purchase Information
You agree to provide current, complete, and accurate purchase and account information. You are responsible for promptly updating your account details (including email address and payment information) to ensure that we can complete your transactions and contact you regarding your order.
6. Returns Policy
ShaRique Skin does not accept returns for skincare products, supplements, or any other physical goods due to hygiene and safety reasons.
1. Defective or Damaged Goods In accordance with the South African Consumer Protection Act (CPA), consumers have the right to return goods if they are defective, damaged on delivery, or do not match the provided description.
Notification: You must notify us of the defect within 7 days of delivery.
Resolution: A refund or exchange will be issued once the product has been returned to and inspected by ShaRique Skin. This process is typically completed within 30 days of receipt.
2. Change of Mind- If a product is not defective and the consumer simply changes their mind, ShaRique Skin is not legally obligated to accept the return. Any returns or exchanges in these instances are handled at our sole discretion as a matter of customer service.
3. Digital Products There are strictly no returns, refunds, or exchanges on any digital products or downloads.
4. Return Process To initiate a return for a defective item:
Email info@shariqueskin.co.za with a valid reason for the return and attach clear photographs of the damage or defect.
Once approved, package the product securely in its original packaging.
We will provide the buyer with a waybill number to be attached to the package.
The buyer must be available for the courier collection. If a collection is missed, ShaRique Skin will not be held liable for additional return costs.
Important Note: Skin Reactions
While we provide detailed ingredient lists and educational guidance to help you make an informed choice, ShaRique Skin does not accept returns or offer refunds based on individual skin reactions.
Subjectivity: Skin sensitivity is highly individual and can be influenced by various external factors, existing routines, or underlying conditions.
Patch Testing: We strongly urge all customers to perform a patch test as directed before full application.
Expert Guidance: If you experience a reaction, please contact us for guidance on how to adjust your usage, but please note that this does not qualify the product as “defective” for a return.
Third-Party Tools and Websites
1. Access to Optional Tools
We may provide you with access to third-party tools (such as payment gateways or shipping trackers) over which we neither monitor nor have any direct control.
“As Is” Basis: You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations, or conditions of any kind.
User Risk: Any use of optional tools offered through the Site is entirely at your own risk and discretion. You should ensure that you are familiar with and approve of the terms and privacy policies provided by the relevant third-party provider(s).

ShaRique Skin shall not be liable for any loss, expense, claim, or damage—whether direct, indirect, or consequential—arising from your use of such websites or your reliance on any information contained therein.

4. Data Protection and Third Parties (POPIA Compliance)
While we partner with reputable service providers to facilitate payments and logistics, ShaRique Skin shall not be held responsible for the independent privacy policies or contract terms of any external websites to which the Site may link. We recommend reviewing the Privacy Policies of these third parties (such as Yoco or PayFast) to understand how they manage your personal information.
This section is very important, but it currently contains some outdated legal references that could put you at risk. Specifically, it relies heavily on the ECTA, whereas South Africa now strictly follows POPIA (Protection of Personal Information Act) for privacy.
Also, your “Unsolicited Information” clause is very broad—it essentially says you “own” anything a user posts. Under POPIA, users always retain certain rights to their personal data. I have modernized this to protect your brand while ensuring you are legally compliant with current 2026 standards.

Medical Privacy: Submissions containing sensitive medical history or confidential health data will be treated with the highest level of privacy and will not be shared without your explicit written consent.
